Sofia Vergara s Awful Frozen Embryo Fight With Nick Loeb Might Finally Be Over
Get the Full StorySofia Vergara just won her latest legal battle against her ex-fianc Nick Loeb, and Page Six is saying this could be the legal battle that prevents any more courtroom showdowns over the two frozen embryos Nick has been trying relentlessly to bring to term for six years. This fight s best before date appears to be up.Since 2015, Nick has been trying to convince a court, any court, that he should be allowed to pursue the viability of two frozen embryos he made with Sofia when they were together. Nick and Sofia were planning for a future, hence the embryos. But then they broke up, and Sofia didn t want the embryos brought to term without her consent. He tried it in California, then Louisiana, both of which didn t work out for him. Last month, the state of Louisiana accused Nick of making a mockery of the legal system by pretending he was a resident of Louisiana, in an attempt to establish that he should be granted the right to bring his precious embryos to term. A judge threw out his appeal on a previous judgment, and basically told him to GTFO out the Pelican State.
Nick has gotten pretty creative over the past six years, but he s going to have to think real hard to come up with a scheme to beat Sofia s latest victory. A Los Angeles Superior Court just granted Sofia a permanent injunction that will ban Nick from turning those embryos into children without explicit written consent from Sofia herself. One point for Sofia, and one deducted from Nick, who apparently pulled a legal no-no when he sued Sofia for custody of the embryos in Louisiana. via Page Six:
The judge further found that Loeb breached a contract between the former couple when he set up a trust for the embryos under Louisiana law, and sued for custody there on the embryos behalf.
The injunction will keep Loeb from unilaterally asserting any claim s by or on behalf of the Embryos to seek relief for the purpose of unilaterally bringing the Embryos to term without Vergara s consent, Judge Rafael Ongkeko wrote.
TMZ adds that the judge is really just holding up the contract Nick and Sofia signed when they first froze the embryos at a fertility clinic back in 2013. The contract stated that they would need both of their consent before moving forward with the embryos.
Nick has tried to have his lawyers continue to appeal the decisions made in Louisiana, but a few weeks ago, Sofia s legal team filed to block his lawyer from further representing him in the state. So Nick can likely try to keep begging and bothering the court system to grant him permission to use the frozen embryos, but each time he ll probably be met with a judge holding out their hand and asking, So can I have the letter from Sofia saying she also wants that to happen? . On that note, I bet Nick just ordered a dozen autographed 8 10 pictures of the cast of Modern Family off eBay, and is watching a YouTube tutorial on how to forge a signature while he waits for them to arrive.
